These Terms of Use ("Terms") govern your access to and use of the Sublimi iOS application, the website at sublimi.app, and any related services (together, the "Service"). By installing or using Sublimi, you agree to these Terms. If you don't agree, please don't use the Service.
1. Who can use Sublimi
You must be at least 17 years old (or the age of majority in your jurisdiction, whichever is greater) and able to enter a binding contract. Sublimi is rated 17+ for mature/suggestive themes. If you're using the Service on behalf of an organization, you represent you have the authority to bind that organization.
2. Your account
You're responsible for everything that happens under your account, including keeping your sign-in credentials confidential. Notify us at hello@sublimi.app if you suspect unauthorized access. Sublimi is licensed to you for personal, non-commercial use; one account per person.
3. Subscriptions, trials, and billing
Sublimi offers three subscription tiers:
- Weekly: $9.99 USD per week, auto-renewing weekly.
- Yearly: $79.99 USD per year, auto-renewing yearly. Eligible new users receive a 3-day free trial. If you don't cancel before the trial ends, you will be charged the full yearly price at the start of day 4.
- Lifetime: $199 USD one-time payment, granting access to the Service's current and future Sublimi features for the lifetime of the Service.
All purchases are made through your Apple ID, processed by Apple under Apple's terms. Prices may differ in your local currency or jurisdiction; the price shown in the App Store at the time of purchase is the price you will pay.
3.1 Auto-renewal
Weekly and Yearly subscriptions automatically renew at the same price unless you cancel at least 24 hours before the end of the current period. To cancel, open iOS Settings → your Apple ID → Subscriptions → Sublimi and tap Cancel Subscription. Cancellation takes effect at the end of the current billing cycle.
3.2 Refunds
All payments are processed by Apple, and refund requests are handled by Apple under their refund policy. We cannot issue refunds directly. If you're unhappy with Sublimi, please email us at hello@sublimi.app — we read every message and we'll do what we can to make it right.
3.3 Lifetime plan scope
"Lifetime" means for the lifetime of the Sublimi service as it currently exists. If we are acquired, sunset, or fundamentally change the Service, you will receive at least 60 days' notice and a pro-rated refund for the time remaining, calculated against an average user lifetime of 10 years.
4. AI-generated content
Sublimi uses third-party AI models (currently Anthropic's Claude and ElevenLabs' voice synthesis) to generate affirmations and audio based on the inputs you provide. Subject to your compliance with these Terms, we grant you a perpetual, worldwide, royalty-free license to use the audio tracks generated for you, for personal purposes including listening, sharing on social media, and creating personal content.
Commercial use — including but not limited to sale, redistribution as a paid product, or use as the primary audio in commercial film, advertising, or broadcast — requires our written permission.
AI output is probabilistic. While we apply safety filters and we hand-curate prompts, we cannot guarantee the content is accurate, appropriate for every situation, or free of imperfections. Don't rely on Sublimi for medical, legal, financial, mental-health, or safety-critical decisions. See §7.
5. Acceptable use
You agree not to:
- Use Sublimi to generate content that is sexual content involving minors, real-person impersonation without consent, threats, harassment, hate speech, or content that incites violence or self-harm.
- Attempt to extract, reverse-engineer, or train competing AI models on our outputs.
- Resell, sublicense, or distribute the audio tracks commercially without our written permission.
- Bypass, disable, or interfere with security or rate-limiting features.
- Use Sublimi to make medical, financial, or legal claims about other people.
- Use the Service in any way that violates applicable law or another person's rights.
We may suspend or terminate accounts that violate this section, with or without notice depending on the severity. Egregious violations may also be reported to law enforcement.
6. Voice cloning
If you use the voice-clone feature, you confirm that the voice you upload is your own — or that you have the recorded individual's explicit, written consent. You may not clone the voices of public figures, celebrities, or anyone who has not explicitly consented. We will permanently delete cloned voices on your request, and we automatically delete cloned voices that are unused for more than 30 days.
7. No medical, legal, or financial advice. No outcome guarantees.
Sublimi is a wellness audio product. It is not a substitute for professional medical, mental-health, legal, or financial advice. Sublimi does not diagnose, treat, cure, or prevent any disease. Affirmations are not promises of outcomes. If you have a medical condition or are experiencing a mental-health crisis, please seek a licensed professional or contact your local emergency services.
8. Intellectual property
The Service — including the app, website, brand, source code, design system, and underlying technology — is owned by Sublimi and protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms.
9. Privacy
Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your information. By using Sublimi you consent to our processing of your data as described there.
10. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBLIMI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.
12. Indemnification
You agree to indemnify and hold harmless Sublimi, its officers, employees, and contractors from any claim arising out of your breach of these Terms, your misuse of the Service, or your violation of another's rights.
13. Termination
You may stop using Sublimi at any time and may delete your account from within the app. We may suspend or terminate access for breach of these Terms, fraud, or as required by law. Provisions intended to survive (IP, disclaimers, liability, governing law) will continue in effect after termination.
14. Changes to the Service or Terms
We may update these Terms from time to time. Material changes will be communicated in-app and via email at least 14 days before they take effect (except for changes required by law, which take effect immediately). Continued use of the Service after the effective date constitutes acceptance.
15. Governing law and dispute resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You and Sublimi agree to attempt to resolve disputes informally first by contacting hello@sublimi.app. If we can't resolve a dispute within 60 days, it will be settled by binding arbitration in Toronto, Ontario, except that you may bring claims in small-claims court. Class actions are not permitted.
16. App Store EULA
Your license to use the Sublimi iOS app is also subject to Apple's standard Licensed Application End User License Agreement. If these Terms conflict with that EULA, that EULA controls only with respect to the relationship between you and Apple; these Terms otherwise govern your relationship with Sublimi.
